Definitions of Terms and Conditions
The Customer is the party that concludes an agreement with Nederlands Taal Onderwijs and owes Nederlands Taal Onderwijs the payments under the agreement, such as lesson fees and tuition. If the customer is a natural person who participates in the lessons, he or she is also a participant under these conditions.
The Participant is the natural person (student/child) who participates in lessons.
The Agreement is between Nederlands Taal Onderwijs and the customer. Nederlands Taal Onderwijs must provide one or more participants with one or more services or products upon payment by the customer.
Product: The lessons and electronic or physical products associated with the classes and accompanying material supplied to the customer by Nederlands Taal Onderwijs.
Tuition Fee: The total amount due for the respective lessons.
Terms and Conditions: These terms and conditions of Nederlands Taal Onderwijs.
Lesson Scheduling and Cancellation Policy
Scheduling: Lessons are planned and recorded in the agreement with a fixed day and time. Lessons can be rescheduled by the student or customer.
Rescheduling and Cancellation: Lessons can be rescheduled if an email is sent at least 48 hours before the scheduled lesson time. If cancellation or rescheduling occurs with less than 48 hours notice, the full lesson fee will be charged. In the case of a no-show (student does not attend and has not rescheduled), the full lesson fee will be charged. If the student arrives late, the agreed lesson time will still be followed, and the complete lesson will be charged.
Lesson Carryover (Monthly Plans Only): Lessons scheduled for a month that are not used (due to rescheduling by Nederlands Taal Onderwijs for legitimate reasons) can still be taken in the following month. No additional charge applies for makeup lessons taken in the following month. Unused lessons expire after the month in which they were scheduled, unless otherwise agreed in writing. Upon cancellation of the monthly agreement, the current month's lessons must be completed or paid in full.
Trial Lesson or Initial Assessment: A free 15-minute initial consultation/assessment is offered to all new students. This assessment is non-binding and requires no payment. If a scheduled trial lesson is not attended and no rescheduling notification is provided, a cancellation fee of €[AMOUNT] will be charged.
Payment Terms
Monthly Payment Plan (Pay-As-You-Go): Invoices are sent at the beginning of each month for lessons scheduled for that month. Payment is due before the start of lessons that month. Automatic renewal occurs each month unless cancelled. Cancellation requires 2 weeks' notice via email. No long-term commitment required.
Annual Payment Plan (38 Lessons/Year - Save 5%): Covers approximately 1 lesson per week for 38 weeks per year. Invoice is sent before the start of the lesson period. Payment is due in full before the first lesson. Automatic renewal occurs 2 weeks before the annual period ends. Cancellation requires 1 month's notice via email (loss of 4 lessons worth of fees). No refunds for unused lessons once the annual period has commenced.
Payment Method and Fees: Payment must be made via bank transfer to [PAYMENT DETAILS PLACEHOLDER]. The customer bears all bank transfer fees (both sending and receiving). Please verify your bank's transfer fees before payment.
Late Payment and Default: If payment is not received within 7 days of the invoice date, a reminder will be sent by email. A second reminder will be sent if payment is not made following the first reminder. Failure to pay on time constitutes default by operation of law. A late payment fee of €7.50 will be charged for each reminder. If payment is not made after written reminders, Nederlands Taal Onderwijs reserves the right to suspend or terminate lessons, refer the account to a debt collection agency, charge collection costs of 15% of the outstanding amount (minimum €50.00), and pursue legal action to recover the debt. All collection and legal costs are to be covered by the customer.
Price Adjustments: Nederlands Taal Onderwijs reserves the right to adjust rates annually based on inflation, wage trends, and operational costs. Price changes are communicated at least 30 days in advance. New rates take effect on January 1 of the new calendar year. Existing monthly agreements are not affected by price changes until renewal. Annual agreements at the new rate apply to the next subscription period.
Lessons Are Non-Refundable
Important: Once lessons have been scheduled and the invoice has been issued, lessons are non-refundable. This applies to both monthly and annual payment plans. The only exception is if Nederlands Taal Onderwijs cancels a lesson due to exceptional circumstances (teacher illness, technical issues beyond student control). In such cases, the lesson will be rescheduled at no additional cost.
Participant Conduct and Expectations
Student Responsibilities: The participant must attend lessons at the scheduled date and time. The participant should have a quiet, distraction-free learning environment for online lessons. The participant is expected to arrive on time with necessary materials. The participant should engage respectfully with the instructor. The participant should inform Nederlands Taal Onderwijs of any learning difficulties or special needs.
Recording and Privacy: Lessons are not recorded without explicit prior written consent from the customer and participant. The participant may not record the lesson without prior written permission. The participant may not screenshot or share lesson materials without permission. Any recordings made by Nederlands Taal Onderwijs are for internal training use only and will not be shared with third parties.
Technology Requirements: The participant is responsible for having a reliable internet connection during lessons. Technical difficulties on the participant's end do not constitute grounds for a refund or reschedule without notice. Nederlands Taal Onderwijs will make reasonable efforts to reschedule if technical issues originate from our systems.
Communication and Contact
General Communication: All cancellations, rescheduling requests, and inquiries must be sent via email. Email requests must be sent at least 48 hours before the scheduled lesson (or 2 weeks for monthly cancellations, 1 month for annual cancellations). Nederlands Taal Onderwijs will respond to emails within 2 business days.
Parent Progress Updates: For students under 18, parents/guardians will receive quarterly progress reports. Additional progress updates can be requested via email. Parents are encouraged to communicate any concerns or feedback.
Customer Responsibilities
The customer is responsible for all payments as outlined in this agreement. The customer is responsible for providing accurate contact information. The customer must inform Nederlands Taal Onderwijs immediately if there are changes in contact details or payment information. The customer agrees to communicate respectfully with Nederlands Taal Onderwijs staff.
Liability and Limitations
Nederlands Taal Onderwijs is Not Responsible For: Technical issues on the student's end (internet connectivity, device problems). The student's lack of progress (Nederlands Taal Onderwijs provides instruction; the student is responsible for engagement and practice). Disruptions to lessons due to the student's environment or circumstances beyond our control. Third-party platform outages (Google Classroom, NUMO.nl, Junior Einstein, Google Workspace).
Nederlands Taal Onderwijs is Responsible For: Providing qualified instruction according to the agreed program level. Delivering lessons at the scheduled time (unless exceptional circumstances prevent this). Maintaining student data privacy and security as outlined in our Privacy Statement. Responding to communication within 2 business days.
Dispute Resolution
If a dispute arises between the customer and Nederlands Taal Onderwijs: The parties will attempt to resolve the matter through direct communication via email. If unresolved after 14 days, a formal written complaint may be submitted. Nederlands Taal Onderwijs will respond to formal complaints within 14 days. If the matter remains unresolved, either party may seek mediation or legal action as permitted by Dutch law.
Termination of Agreement
By Customer: Monthly plans require cancellation with 2 weeks' notice via email. Annual plans require cancellation with 1 month's notice via email (loss of 4 lessons worth of fees). Notice must be submitted before the applicable notice period expires.
By Nederlands Taal Onderwijs: Nederlands Taal Onderwijs reserves the right to terminate the agreement if payment is not received 30 days after a final written notice of default. The participant violates the conduct policies outlined in these terms. The participant repeatedly fails to attend scheduled lessons without notice. The fit between the participant's needs and Nederlands Taal Onderwijs's services is not appropriate. In such cases, Nederlands Taal Onderwijs will provide written notice of termination with 2 weeks' advance notice (except in cases of severe misconduct).
Amendments to Terms and Conditions
Nederlands Taal Onderwijs reserves the right to modify these Terms and Conditions at any time. Changes will be communicated to customers at least 30 days in advance. Continued use of the services after the notice period constitutes acceptance of the new terms.
Applicable Law
These Terms and Conditions are governed by the laws of Spain Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the Spanish courts.
